Terms and Conditions

  1. Participants in the Lambrini Free heat Magazine promotion are bound by these terms and conditions.
  2. Only those resident in the UK aged 18 or over are eligible to claim. Purchase necessary.
  3. Employees of the Promoter or any business involved or associated with this promotion, any of the Promoter’s agencies and any of their parent and/or affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to participate. The Promoter reserves the right to verify eligibility.
  4. The promotion opens at 09:00 on 15 September 2014 and closes at 20.00 on 27 February 2015.
  5. Claimants will require access to a telephone or a mobile telephone with a text function to participate in the promotion.
  6. To claim, purchase a promotional bottle of Lambrini Original, Cherry, Peach or Strawberry 75cl and either Telephone 0800 665 491 between the hours of 9.00hrs GMT until 20.00hrs GMT Monday to Friday or 09.00hrs GMT until 18.00hrs GMT Saturday to Sunday (“Opening Hours”); or Text LAMBRINI to 78070 to receive a call back within 2 working days during the Opening Hours.
  7. Calls are free from UK BT landlines. Mobile & other provider charges may apply. Texts will be charged as one text message at your standard network rate.
  8. During the claim process, claimants must provide their contact details (including their name, address, daytime telephone number & e-mail address) and their Promotional Code, which can be found underneath the back label of promotional bottles. All telephone calls will be recorded. Claimants should retain their label until they have received their magazine.
  9. Promotional bottles available in selected stores while stocks last.
  10. For the avoidance of doubt, you must purchase one promotional bottle for each free magazine claimed. Promotional codes cannot be used more than once.
  11. Only one magazine can be claimed per household.
  12. Claimants will receive 1 x copy of the next available issue of heat magazine within 17 days of making a valid claim. The magazines will be sent via first class post. Magazines will be posted to UK addresses only.
  13. There are no alternatives, except in the event of circumstances outside of its control; the Promoter reserves the right to substitute alternative magazines of similar value. There is no cash alternative.
  14. All claims must be made directly by the person entering the promotion. Claims made by such methods as automated devices or processes are not allowed, and will be disqualified. Any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party. By entering this promotion, you hereby warrant that all information submitted by you is true, current and complete.
  15. Any personal data relating to participants will be used in accordance with current UK data protection legislation. Bauer Consumer Media Limited, a company registered in England with company number 01176085 whose registered office is at 1 Lincoln Court, Lincoln Road, Peterborough, PE1 2RF will handle, manage and fulfil all heat magazine claims. Bauer will process claimant’s Personal Data and/or the addressee’s Personal Data for the purposes of administering this promotion and in accordance with Bauer’s Privacy Policy which can be found at www.bauerdatapromise.co.uk. Bauer will act as Data Controller and Data Processor for the purposes of data protection legislation. By entering this promotion, all claimants consent to Bauer collecting and using their Personal Data for these purposes. During the claim process, Bauer will ask claimants if they would like to receive future marketing communications from the Bauer Media Group and/or the Promoter by phone, email and post. If claimants agree to receive future marketing communications from the Promoter, claimants consent to Bauer transferring their Personal Data to the Promoter for these purposes. Claimants can opt-out of future communications at any time.

  17. The Promoter will do all that is reasonably possible to ensure that the claim line and text facility are functional throughout the period of the promotion. However, the Promoter will not be responsible for defects or malfunctions in the operation & administration of the promotion, however caused.
  18. The Promoter will not be responsible for promotional codes which are damaged due to the manner in which the product has been handled.
  19. In the event of any dispute regarding the promotion, the decision of the Promoter is final and no correspondence or discussion shall be entered into. The Promoter reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant’s conduct or intention is contrary to the spirit of the terms and conditions or does not follow the rules of the promotion.
  20. Owing to exceptional circumstances outside its reasonable control and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions at any stage but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
  21. The Promoter reserves the right to disqualify any individual it finds to be tampering with the operation of the promotion or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner. Any attempt by any person deliberately to undermine the legitimate operation of the promotion may be a violation of criminal and civil law and, should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. The Promoter’s failure to enforce any of these Terms and Conditions shall not constitute a waiver of that provision.
  22. Except where prohibited, entrants agree that: (1) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event legal fees; and (2) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages otherwise increased. Subject to clause 23, and subject to any liability arising as a result of its fraud or fraudulent misrepresentation, the Promoter’s liability for claims related to this promotion is limited to a maximum of three thousand pounds.
  23. To the extent permitted by law, the Promoter is not liable for any injury or damage to persons or property which may be caused, directly or indirectly, from any entrant’s participation in the promotion or from any free gift.
  24. The Promoter does not take responsibility for, recommend or guarantee the performance of any contractual or other obligations of third parties associated with heat magazine. The Promoter shall not be liable for any non-performance of any contractual or other obligations by any third party nor any fraud committed by any third party. The Promoter is not liable for the content of heat magazine and does not endorse its content.
  25. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby agree to the non-exclusive jurisdiction of the English courts.
